Auction Law

Beers Mallers Backs & Salin, LLP prides itself on being one of the few law firms that practices in the area of auction law. Currently, the auction law team consists of licensed attorney and auctioneer Kurt R. Bachman and licensed attorney Joshua A. Burkhardt. Together these individuals have represented auctioneers with services ranging from just providing legal advice regarding auction law, to drafting auction forms such as registration agreements, auction contracts and purchase agreements, to vigorously representing and defending auctioneers in a court of law.

Kurt R. Bachman has been a licensed auctioneer since 1987 and licensed attorney since 1989 in the State of Indiana. Currently, he is a partner with Beers Mallers and devotes a significant portion of his practice to auction law. Mr. Bachman is a member and Special Counsel to the National Auctioneers Association and is a lifetime member and General Counsel to the Indiana Auctioneers Association.

Mr. Bachman is also the author of “Waiting for the Hammer to Fall: A General Overview of Auction Law” (2002), and is frequently asked to write articles for both national and state publications. In addition, Mr. Bachman has been retained to serve as an expert witness on auction law matters.

Joshua A. Burkhardt has been a licensed attorney in the State of Indiana since 2001. Currently, he is an associate attorney with Beers Mallers and practices in the areas of auction law, appellate law, and commercial litigation. Prior to acceptance to the Indiana Bar Association, he graduated with the highest distinction from Ohio Northern University College of Law, and has been able to build on his unique experience as a federal judicial law clerk (2001-2002) with the United States District Court, Southern District of Indiana, Indianapolis Division, with Honorable John D. Tinder and Honorable David F. Hamilton.

During Mr. Burkhardt’s tenure with Beers Mallers, he was lead appellate counsel on behalf of the National Auctioneers Association, as amicus curiae, in Penetta v. Equity One, Inc., 190 NJ 307, 920 A.2d 638 (N.J. 2007).

Together, Mr. Bachman and Mr. Burkhardt co-authored “Uniform Auction and Auctioneer Licensing Act (“UAALA”) (2006) and “Waiting for the Hammer to Fall: A Guide for Auctioneers” (2008).
